SWITZERLAND HAS INTRODUCED A NATIONWIDE BAN ON COVERING THE FACE IN PUBLIC, A LAW WIDELY REFERRED TO AS THE “BURQA BAN,

 

 BUT THE CLAIM THAT SWITZERLAND IS THE FIRST COUNTRY TO DO SO IS NOT CORRECT. The Swiss law officially came into force on January 1, 2025, after voters narrowly approved a constitutional initiative in a nationwide referendum in 2021. Under the Federal Act on the Ban on Covering the Face, people are generally prohibited from concealing their faces in public places and in private spaces that are accessible to the general public. The rule therefore applies to garments such as the burqa and niqab, but the legislation itself is written broadly as a face-covering prohibition rather than a ban targeting one religion by name.  Anyone violating the law can normally receive an on-the-spot fine of CHF 100, while cases proceeding through the ordinary legal process can result in fines of up to CHF 1,000, which was approximately US$1,144 when the measure was announced.  There are several important exceptions. Face coverings remain permitted in places of worship, as well as for health and safety reasons, protection against weather conditions, traditional customs, artistic performances, entertainment and certain other circumstances.  Supporters argue that the measure promotes public security, easier identification and social interaction, while critics contend that it disproportionately affects Muslim women who wear full-face Islamic coverings and raises questions about personal liberty and religious freedom.  Switzerland, however, was not the first country in Europe to introduce such restrictions. France became the first European country to implement a nationwide prohibition on full-face coverings in public spaces in 2011, followed by Belgium and several other European countries.  Ultimately, Switzerland’s decision reflects a continuing European debate over security, integration, individual choice and religious expression. Whether one supports or opposes such restrictions, policies affecting religious practices should be discussed with accurate facts and equal respect for everyone’s rights.
